Acceptance
By using Words Left, you agree to these terms. If you do not agree, do not use the platform.
Service description
Words Left is a free, encrypted message delivery platform. Messages are stored and delivered according to user-configured safety checks. The platform does not guarantee delivery timing or availability.
User responsibilities
- You are solely responsible for the content of your messages
- You must not use the platform for threats, harassment, illegal content, or to cause harm
- You are responsible for safely storing your edit code and passphrase
- You must provide a valid email address for safety checks
Content responsibility
Because messages are end-to-end encrypted, the platform cannot moderate content. The sender bears full legal responsibility for message content. The platform operates as a neutral delivery service.
Recipient consent
All recipients must explicitly consent to receiving a message before the delivery system is armed. Recipients may decline at any time before delivery.
Limitation of liability
The platform is provided "as is" without warranties of any kind, express or implied. We are not liable for: message loss, delivery failure, accidental delivery, emotional distress caused by message content, or any damages arising from platform use.
To the fullest extent permitted by applicable law, our total liability for any claim arising from or related to this service shall not exceed the greater of (a) $100 USD or (b) the total amount you have paid to us in the twelve months preceding the claim. Because Words Left is currently provided free of charge, our maximum liability is $100 USD.
In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or emotional harm, even if we have been advised of the possibility of such damages.
Indemnification
You agree to indemnify and hold harmless the platform operators from any claims, damages, or expenses arising from your use of the service or the content of your messages.
Termination
We reserve the right to terminate access to the platform for violation of these terms. You may delete your data at any time using your edit code.
Age requirement
You must be at least 18 years old to use Words Left. By using the platform, you confirm that you meet this age requirement. We do not knowingly accept messages from users under 18.
Prohibited content
While we cannot read or moderate encrypted messages, you agree not to use the platform to transmit:
- Defamatory or false statements about living persons
- Information protected by non-disclosure agreements (NDAs) or confidentiality obligations
- Attorney-client privileged information
- Threats, blackmail, extortion, or harassment
- Instructions for illegal activities
- Content intentionally designed to cause emotional harm to the recipient
Violation of these restrictions may expose you or your estate to legal liability. The platform bears no responsibility for prohibited content transmitted through the service.
Legal disclaimer
- Words Left is a transmission medium, not a content creator or publisher. We do not generate, review, or endorse any user-created message content.
- All messages are end-to-end encrypted. The platform has no ability to access, read, or moderate message content. This qualifies the platform for safe harbor protections under applicable law, including Section 230 of the Communications Decency Act.
- The sender bears full legal responsibility for all message content. This responsibility may transfer to the sender's estate after death.
- If a posthumous message contains defamatory statements about a living person, that person may have legal recourse against the sender's estate. The platform is not liable in such cases.
Intellectual property
The Words Left name, logo, and platform design are the intellectual property of the platform operators. You retain full ownership of any content you create and transmit through the service. By using the platform, you grant us only the technical rights necessary to store and deliver your encrypted message — we claim no ownership or license over your content.
Dispute resolution
Before initiating any formal legal action, you agree to contact us at wordsleft@protonmail.com to seek an informal resolution. We will attempt to resolve any dispute within 30 days.
If informal resolution fails, disputes shall be resolved through binding individual arbitration administered under the rules of the American Arbitration Association (AAA), conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this clause prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
EU/EEA residents: The above arbitration clause does not affect your statutory rights under EU consumer protection law, including the right to bring a claim before your local courts or an EU online dispute resolution platform (ec.europa.eu/consumers/odr).
Governing law
These terms are governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to conflict of law principles. Subject to the dispute resolution clause above, any disputes shall be subject to the exclusive jurisdiction of the courts of Delaware. Words Left is a globally accessible service operating under a US-based legal framework.
